Jon- The NRB adopted a Criterion 9(L) Guidance on March 8, 2016, effective March 15, 2016.  This Guidance supersedes the Criterion 9(L) Procedure adopted on October 14, 2014 (effective October 17, 2014).

In addition to elaborating on a number of definitions and criteria in the Statute (including Efficient Use), the Guidance provides a flowchart (including a question regarding residential projects), which may be helpful for your analysis.

Does anyone have some recent decisions/ learning on criteria 9 (L).  in particular I am looking for information on what constitutes efficient use of the land when the developer wants a single family home for his own use and two other single family home lots in an area that is surrounded by deeryards for which large setbacks and limited human activity is requested by anr.
