At a meeting at NASIG this past summer, a presenter said (I can't remember
who, or at which session this was said) that the shrink wrap licenses would
never stand up in court if a suit ever resulted from the abuse of one.  Even
though I didn't write down who said this, it made sense to me.  Carole
